  • Both Office 365 Core and Advanced eDiscovery functionality may be useful for a variety of investigations beyond their use as a tool in preparation for litigation.
  • Updates to Office 365 Advanced eDiscovery functionality make cases for investigations easier to create and manage and help find and prepare only the relevant documents.

Office 365 eDiscovery includes functionality designed to assist an organization with a variety of investigations, including discovery required by legal cases. The eDiscovery feature is separated into Core eDiscovery functionality, which is included in Office 365 E3 subscriptions, and the easier to use and more analytical Advanced eDiscovery functionality, which is included in Office 365 E5 subscriptions. Advanced functionality includes an improved case management workflow (currently in preview), and the ability to use machine learning to train the feature to locate relevant documents. (For an overview of eDiscovery and how it could be used for investigations, see the sidebar “Why Bother with eDiscovery? No One Is Suing Us“.)
